1. Who we are
This website, poseidonequipment.com, is operated by Pure Divisions Inc., doing business as Poseidon Equipment ("Poseidon Equipment", "we", "us"). Our address is 7123 I-30 Frontage Rd, Suites 3 and 4, Little Rock, AR 72209. By using this website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.
2. Products and descriptions
We work to describe our products accurately. Specifications, ratings and photos come from manufacturers and may change, and colors or details can look different on your screen. If a detail matters for your setup, contact us before you order.
3. Prices and availability
Prices are in US dollars and can change without notice. Items marked "Coming soon" are not for sale yet. If a product is listed at a wrong price or is no longer available, we may cancel the order, and if we cancel after you paid, we refund that payment in full.
4. Orders and payment
Your order is an offer to buy. We accept it when we ship it, or when it is ready for pickup. We may refuse or cancel any order, for example if we suspect fraud. Payment is due at checkout, using the payment methods shown there.
5. Sales tax and tax-exempt contractors
Sales tax is charged on all taxable orders as required by law. Approved contractors who hold a valid resale or exemption certificate, license or number can buy tax exempt. Send us your certificate before you order. We review it and, once approved, set your customer account to tax exempt. Tax already charged on an earlier order is not refunded unless the law requires it.
6. Shipping, pickup and delivery
Shipping, freight, pickup and delivery are covered by our Shipping policy. Some items do not ship to California.
7. Returns and warranty
All sales are final, except as described in our Refund policy. Products carry the manufacturer's warranty. Except for that warranty and our 30-day warranty in the Refund policy, and to the extent the law allows, products are sold "as is" and we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
8. Rig builds and custom orders
Custom rigs and builds are made under a separate build contract. A build can be cancelled only before that contract is signed. Deposits are not refundable, and parts already ordered for a build are not refundable. If the build contract and these Terms conflict, the build contract controls.
9. Safe use
Pressure washing and soft washing equipment, engines and cleaning chemicals can cause injury or damage if misused. Follow the manufacturer's instructions and safety warnings, use proper protective equipment, and follow local laws for chemicals and wastewater. You are responsible for using the products you buy safely and properly.
10. Limitation of liability
To the fullest extent the law allows, Poseidon Equipment and Pure Divisions Inc., and their owners, employees and suppliers, are not liable for any indirect, incidental, special or consequential damages, including lost profits, lost jobs or downtime, arising from your use of this website or the products you buy. Our total liability for any claim related to a product is limited to the amount you paid for that product.
11. Website content
The text, photos, logos and other content on this website belong to Poseidon Equipment or its suppliers and may not be copied or used without our permission. We may change or discontinue any part of the website at any time. Your use of the website is also covered by our Privacy policy.
12. Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Pulaski County, Arkansas, unless the law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The version posted on this page when you place an order applies to that order.
14. Your rights
Nothing in these Terms limits any rights you have under applicable law that cannot be waived.
